Congress enacted in 1991 the Telephone Consumer Protection Act (TCPA) to regulate this practice. The TCPA restricts the making of telemarketing calls and the use of automatic telephone dialing systems and artificial or prerecorded voice messages. The FCC has determined that robo text messages can violate federal law when they are sent without the prior express consent of the called party.

There are other potential legal violations associated with medical bill text messages from US Acute Care Solutions. Many people that go to the hospital have medical insurance or worker´s compensation insurance that is supposed to cover their medical bills. Healthcare providers should bill insurance before trying to collect the entire bill from the patient. In California it is illegal for a healthcare provider to bill an injured worker when they know that the claim should be paid by worker's compensation insurance. You should not pay out of pocket for healthcare bills that are supposed to be covered by insurance.
